Terms of Service
The short version
MakeItFit is a scheduling platform that connects personal trainers and their clients. Trainers and clients agree their own terms with each other; we provide the tools — agreements, booking, messaging, payments, and calendar sync. Use the service fairly, pay for what you book under the agreement you accepted, and treat the people you train with respectfully. These terms and the privacy policy together govern your use of MakeItFit.
1. Who we are
MakeItFit is operated by Fontaine Farm SRL, Brussels, Belgium (“MakeItFit”, “we”, “us”). You can reach us at daniel@garden-stack.com for legal questions and everything else.
2. What MakeItFit is — and is not
MakeItFit lets personal trainers and clients set up training agreements, book and reschedule sessions, message each other, and handle session payments. Trainers on MakeItFit are independent professionals. They are not our employees, agents, or partners, and we do not supervise, direct, or control the training they deliver. The training relationship — including the quality, safety, and suitability of any session — is between the trainer and the client. We are not a party to training agreements; we provide the platform on which they are made.
3. Your account
- You must be able to enter into a binding contract — in Belgium that means being at least 18, or using MakeItFit with the consent of a parent or guardian who accepts these terms for you.
- Keep your sign-in method (Sign in with Apple, Google sign-in, an email magic link, or email-and-password sign-in where a password has been set) secure. You are responsible for activity on your account.
- Provide accurate information — your counterpart relies on your profile, working hours, and availability being truthful.
- One account per person. Do not impersonate anyone or misrepresent a qualification.
4. Agreements, bookings, and cancellations
A training agreement on MakeItFit records what trainer and client have agreed: session price, session length, sessions per week or session credits, and a cancellation notice period measured back from the original session start. The accepted agreement controls that timing; MakeItFit does not apply a universal 24-hour or 48-hour cancellation period.
- Use the session action in the app to send a cancel or reschedule request. The booked session changes only when the other party approves that request.
- For the agreement’s timing calculation, a request submitted at least the stated number of hours before the original start is on time. A request submitted exactly at the notice-period boundary is treated as on time; one submitted inside the notice period is late.
- A late cancellation or no-show may remain payable at the agreed session price under the active agreement. MakeItFit may attempt an off-session card charge only where the client explicitly saved a card and authorised its use for late-cancellation or no-show amounts due under that agreement. Removing the saved card stops future use of that card but does not cancel an amount already due.
- Trainers are responsible for marking sessions completed or cancelled accurately and for honouring the agreements they offer.
5. Payments
- Digital trainer subscriptions purchased in the iOS app are auto-renewing In-App Purchases processed by Apple through StoreKit. Apple charges the Apple ID payment method, provides the price and renewal terms, and handles subscription management and refund requests. Plans renew until cancelled in Apple subscription settings.
- Person-to-person session payments pay for real-world training services supplied by the trainer to the client. Stripe Connect processes the client’s payment and pays the trainer’s connected account. MakeItFit deducts the disclosed platform fee from the trainer’s side. Stripe’s processing costs are paid by MakeItFit and are not deducted from the trainer payout.
- MakeItFit is the platform for session payment processing, not the supplier of the training session. The trainer remains responsible for delivering the service, applicable taxes, receipts, and any professional obligations.
- We never store full card numbers. Apple handles subscription payment details and Stripe handles session-payment details.
- Saving a card for possible late-cancellation or no-show charges is optional and requires a separate consent in the app. Stripe stores the payment method; MakeItFit stores only the Stripe customer/payment-method reference, limited card display details, and the version and time of the consent.
- Refunds for session payments are a matter between trainer and client in the first instance; contact us if you cannot resolve a payment dispute and we will help where we reasonably can.
6. Health and safety
Personal training is physical exercise, and exercise carries inherent risk. MakeItFit is a scheduling tool — nothing in the app is medical advice. Consult a doctor before starting a new training programme if you have (or suspect) any condition that could be affected by exercise, tell your trainer about injuries and limitations, and stop if something feels wrong. Trainers are responsible for the professional advice and instruction they give.
7. Your content and acceptable use
You keep ownership of the content you put into MakeItFit — messages, attachments, your avatar, session feedback, and metrics. You grant us the licence needed to store, transmit, and display that content to the people it is meant for, which is how the service works. Do not use MakeItFit to:
- harass, threaten, or abuse anyone, or send unlawful, infringing, or sexually explicit content;
- spam, scam, or solicit people off-platform to avoid agreed payments;
- probe, overload, scrape, or interfere with the service or other people’s accounts;
- upload malware or content you have no right to share.
Users can block another person and report messages from within the app. Reports are delivered to a human moderation queue and we aim to triage them within 24 hours. We may remove content or restrict accounts that break these rules.
8. Calendar integration
Connecting Apple Calendar, Google Calendar, or Microsoft Outlook/Microsoft 365 Calendar is optional. If you connect one, the app uses busy/free time spans to prevent double-booking, and — if you enable write-back — adds your confirmed sessions to your own calendar. What we do and do not read is described in the privacy policy; counterparts only ever see “Busy”.
9. Intellectual property
The MakeItFit app, website, design, and software are ours or our licensors’. We grant you a personal, non-exclusive, non-transferable licence to use the app and site for their intended purpose. Do not copy, modify, reverse-engineer, or resell them except where the law expressly permits.
10. Ending your account
You can stop using MakeItFit at any time and delete your account from Avatar menu → Account → Delete account in the app. Deletion requires recent confirmation with a sign-in method linked to the account and works as described in the privacy policy. Deleting your MakeItFit account does not cancel an Apple subscription, so cancel it in Apple subscription settings first if you want to stop future renewals. Payment records that applicable bookkeeping law requires us to keep are retained for the legal period. We may suspend or terminate accounts that materially breach these terms, after warning you where that is reasonable. Obligations that by their nature survive — such as payment for sessions already delivered or amounts already due — survive account closure.
11. Liability
We provide MakeItFit with reasonable skill and care, but — to the extent Belgian and EU consumer law allows — we do not guarantee uninterrupted availability, and we are not liable for the conduct of trainers or clients, the outcome of training, or losses caused by events outside our reasonable control. Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence, or any liability that cannot be excluded by law, and nothing reduces the rights you have as a consumer under mandatory law.
12. Changes to these terms
If we change these terms materially we will update this page and note it in the app before the change takes effect. If you keep using MakeItFit after the effective date, the updated terms apply. If you do not agree with a change, stop using the service and delete your account.
13. Governing law and disputes
These terms are governed by Belgian law, without depriving a consumer of mandatory protections or court rights provided by the law that applies to them. Courts with jurisdiction under applicable law may hear disputes; for non-consumer disputes, that will ordinarily be the competent courts of Brussels, Belgium.
Please contact us first through the support page or at daniel@garden-stack.com so we can try to resolve the issue in writing. If a consumer dispute remains unresolved, you may ask the Belgian Consumer Mediation Service or another competent consumer alternative-dispute-resolution body to assess whether it can assist. The European Commission publishes current information about consumer complaint and redress options on its consumer complaint guidance. These options do not limit either party’s right to seek a remedy in court. MakeItFit does not commit to a particular voluntary mediation procedure unless applicable law requires participation or we agree to it for the dispute.
